CORAM

THE HONOURABLE MR.JUSTICE D.HARIPARANTHAMAN W.P.No.12806 of 2015 R.Karthikeyan ... Petitioner Vs.

1. The Director General of Police Dr.Radhakrishnan Salai, Mylapore Chennai - 600 004.

2. The Superintendent of Police Tiruvannamalai District Tiruvannamalai ... Respondents Prayer : Writ Petition has been filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the respondents to consider his representation dated 05.07.2014 forwarded to 2nd respondent by the 1st respondent to appointment of the petitioner as a Grade II Constable. For Petitioner :

Dr.G.Krishnamurthy For Respondents :

Mr.K.V.Dhanapalan, A.G.P

ORDER

With the consent of both sides, this writ petition itself is taken up for final disposal.

2. The petitioner applied for the post of Grade II Police Constable. Though he was selected, he was not given appointment order, pursuant to non-production of required community certificate. Two Division Bench of this court passed orders dated 28.02.2013 in W.P.No.2860/2013 and 06.12.2013 in W.P.No.26830/2013 issued certain directions. As per the order dated 06.12.2013 in W.P.No.26830/2013, the Division Bench directed the Tahsildar, Thiruvannamalai to pass a speaking order. The petitioner has not stated anything about the same, on the other hand he has sought to produce a community certificate obtained from Tiruvallur District and has filed this writ petition seeking for appointment order.

3. Earlier, he produced a community certificate obtained from Thiruvannamlai district. The said community certificate was the subject matter in the above two writ petitions. Hence, the appointment of the petitioner depends on the order that could be passed by the Tahsildar, Tiruvannamalai. He could not now produce a certificate obtained from the Tahsildar, Tirvuallur and seek to get appointment.

4. In these circumstances, I am not inclined to issue direction to dispose of the representation dated 05.07.2014 to provide him employment based on the community certificate issued by the Tahsildar, Tiruvallur, particularly in view of the order dated 06.12.2013 of the Division Bench in W.P.No.26830/2013.

5. Writ petition is dismissed. No costs.
