PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to modify the condition imposed by the Principal District and Session Judge of Kancheepuram District at Chengalpattu in Crl.M.P.No.4677 of 2021 order dated 08.10.2021 which requires the petitioner to deposit sum of Rs.1,00,000/- (One Lakh Rupees) as non-refundable deposit. This Criminal Original Petition has been filed to modify the condition imposed by the Principal District and Session Judge of Kancheepuram District at Chengalpattu in Crl.M.P.No.4677 of 2021 order dated 08.10.2021 which requires the petitioner to deposit sum of Rs.1,00,000/- (One Lakh Rupees) as non-refundable deposit.

Learned counsel for the petitioner submitted that the only grievance of the petitioner is that the second condition imposed by the learned Principal District and Sessions Judge, Kancheepuram is impractical and the petitioner is facing difficulties to deposit the non refundable amount of Rs.1,00,000/- to the Tahsildar, Thiruporur by way of demand draft payable to the credit of "The District Mines and Minerals Foundation Trust". submitted that the petitioner is ready to deposit a sum of Rs.50,000/-.

3. In view of the above, the condition imposed by the learned Principal District and Session Judge of Kancheepuram District at Chengalpattu in Crl.M.P.No.4677 of 2021 order dated 08.10.2021 is modified. The petitioner shall remit a nonrefundable deposit of Rs.50,000/- (Rupees Fifty Thousand Only) to the Tahsildar, Thiruporur by way of demand draft payable to the credit of "The District Mines and Minerals Foundation Trust".

4. With the above modification, this Criminal Original Petition is allowed.
