Today, when the matter is listed for hearing, the learned counsel appearing for the appellant informed the Court that the appellant has already filed an Appeal before the Appellate Tribunal and the same is pending. Therefore, he seeks liberty to proceed the Appeal pending before the Tribunal and for the same, seeks permission of this Court to withdraw the instant Writ Appeal. He has also made an endorsement to that effect.

2. Inview of the above submission and the endorsement made by the learned counsel for the appellant, this Writ Appeal is dismissed as withdrawn, with liberty to proceed the Appeal, pending before the Appellate Tribunal. No costs. Consequently, connected miscellaneous petition is closed.
