ORDER

Challenging the impugned order passed in Crl.A.No.62 of 2022 dated 26.07.2023 passed by II Addl. District and Sessions Court, Chidambaram confirming the order passed in S.T.C.No.346 of 2017, dated 08.11.2022 by the Judicial Magistrate No.2, Chidambaram, the petitioner preferred this Criminal Revision Case.

2. Today, when the matter taken up for hearing, both learned counsel for petitioner and respondent appeared along with parties. Already the cheque amount of Rs.12,00,000/- was deposited. Still there is a balance sum of Rs.5,50,000/- together with interest @ 6% according to the defacto complainant.

According to the petitioner, there was a mediation held between parties, wherein the petitioner has already paid a sum of Rs.7 lakhs, but the same was denied by the defacto complainant, who had also appeared before this Court along with mediator Sowrirajan. Nearly about 7 years, the matter is pending before this court and all these years, the complaint was also filed through various forums. Therefore, the respondent is entitled for compensation. 2/4

However, already major amount of Rs.12,00,000/- was paid. The respondent/complainant is permitted to withdraw the said sum of Rs.12,00,000/- which was already deposited and the remaining sum of Rs.2,50,000/- as part of compensation either through demand draft or by way of cash is ordered to be paid by the petitioner within a period of six weeks from the date of receipt of copy of this order. On such deposit, the respondent/complainant is permitted to withdraw the amount on filing undertaking affidavit. The trial court is directed to return the sum of Rs.12,00,000/- without insisting the original case bundle. On such deposit of the said amount being made, he is acquitted from charges.
