ORDER
The petitioner has filed this Writ Petition challenging the suspension proceedings in No.EA1/567K/2020-2 dated 24.11.2020 and the consequential charges dated 24.11.2020 in 1/567K/2020-1 and quash them and pass appropriate orders.
2.Heard, Mr.M.Kalyanasundaram, the learned senior advocate for the petitioner, and Mr.T.Chezhiyan, the learned Additional Government Pleader for the respondent and perused the materials available on record. 3.Mr.M.Kalyanasundaram, the learned senior advocate for the petitioner submitted that the petitioner has been given with certain charges that he has produced a bogus certificate and also for misconduct in view of the same. It is not known whether any criminal case has been registered in this regard against the petitioner.
4.Per contra, Mr.T.Chezhiyan, learned Additional Government Pleader for the respondents submitted that the petitioner originally worked for daily wages and after completing 10 years, he claims to be posted as a Junior Drafting Officer 2/6
by producing the diploma certificate in Electrical Engineering. Subsequently, the certificate was sent for verification and found to be bogus. During the verification process undergone by the Directorate of Technical Education, due verification was done with the PSG Polytechnic College, Coimbatore, in which the petitioner had studied the diploma course. However, the college has submitted the report by stating the following: ""the petitioner Thiru G.Murasoli name was not found in the list. The certificate also appears to be fake". Based on the mail, the reply was given to AEE, Electrical Sub- Division vide office letter No 108809/M4/2020 dated 17.11.2020 stating that the Diploma Certificate bearing numbers DC243549, produced by Mr. Murasoli G(REG. No. 88E018) in support of his Educational Qualification has not been issued by this Department and found to be Bogus, according to the PSG Polytechnic College Coimbatore (Autonomous)records"
5. The verification done at the end of the Directorate of Technical Education proves that the certificate produced by the petitioner is false and an FIR has also been registered in this regard. It is right on the part of the 1st and 2nd respondent to initiate disciplinary action against the petitioner. The petitioner could have participated in the disciplinary proceedings after availing himself of the opportunity given to him. Instead the petitioner has chosen to challenge the order of suspension and the charge memo. The charge memo has been given only on the basis of verifiable facts that the petitioner has produced a bogus diploma certificate. Hence, I do not find any reason to quash the order. 3/6
