ORDER
This petition has been filed by the petitioner seeking a direction to the respondents 1 to 3 herein to consider and dispose of the petitioner's representation dated 19.12.2025 relating to petitioner's vehicle Toyota Innova Crysta bearing Registration No.TN-63-AQ-8191, registered as CSR No.515 of 2025 on the file of the second respondent, by conducting a fair and proper enquiry and passing a reasoned order within a time frame. 2.The contention of the learned counsel for petitioner is that the petitioner is the owner of Toyota Innova Crysta Motor Car bearing Registration No.TN-63-AQ-8191. While he was working as a call taxi driver, the fourth and fifth respondents frequently travelled in his vehicle and developed a friendship. Further they represented that they require a car on a rental basis for their business and also assured to pay the rental amount. Due to their acquaintance, the petitioner handed over his vehicle to the fourth and 2/5
fifth respondents. Thereafter, the fourth and fifth respondents failed to pay the rent. After repeated requests, they paid a sum of Rs.35,000/- and thereafter stopped paying any further amount. Since the fourth and fifth respondents wrongfully retained the petitioner's vehicle, the petitioner sent a representation dated 18.11.2025 to the respondent police. Though CSR number assigned for the same, so far, no action has been taken. Hence the above petition is filed.
3.The learned Additional Public Prosecutor submitted that after lodging the complaint and obtaining CSR, the petitioner not produced any documents to show that vehicle is now in Chandigarh. He further submitted that the enquiry is in progress.
4.Considering the submissions made and on perusal of the materials, it is seen that the petitioner entrusted his Toyota Innova Crysta Car bearing Registration No.TN-63-AQ-8191 to the fourth and fifth respondents, who undertook to pay the EMI and return the car. Later, the petitioner came to know that the vehicle is not with the fourth and fifth respondents and he was informed that vehicle is in Chandigarh. On the petitioner's complaint CSR No.515 of 2025 assigned on 09.12.2025 and now enquiry is in progress. In view of the same, the third respondent police is directed to cause an enquiry 3/5
