This Civil Revision Petition filed under Article 227 of the Constitution of India, to set-aside the fair and decreetal order dated 05.07.2017 made in I.A. No.52 of 2016 in O.S. O R D E R

This revision arises against the fair and decreetal order dated 05.07.2017 made in I.A. No.52 of 2016 in O.S. No.33 of 2014 passed by the Learned I Additional District Judge, Tiruvallur.

2. The learned counsel for the petitioner submitted that pursuant to the order dated 05.07.2017, passed the I Additional District Judge, Thiruvallur, in I.A. No.52 of 2016 in O.S. No.33 of 2014, the learned Advocate Commissioner has submitted interim report before the court below. Thereafter, the present Revision petition has been filed before this Court.

3. The learned counsel for the 1st respondent submitted that he had filed an Interlocutory Application before the trial court for disobedience of the order by the petitioner and the another Interlocutory Application has been filed to locate the harvested paddy.

4. According to the learned counsel for the petitioner, the said applications have to be tried independently, on merits and in accordance with law. In view of the said submission made by the learned counsel for the petitioner, the civil revision petition has to be dismissed as infructuous and the learned counsel for the respondent has no serious objection for dismissing the revision as infructuous.

5. Therefore, this Civil Revision Petition is dismissed as infructuous. Consequently, connected Miscellaneous Petition is closed. No costs.
