ORDER

Alleging that the order of this Court dated 11.09.2025 passed in W.P.No.34259 of 2025 has not been complied with, the present contempt petition has been filed.

The petitioner preferred W.P.No.34259 of 2025 seeking a writ of mandamus directing the respondents therein to promote her as Assistant with effect from 15.03.2012 from the date of her promotion as Junior with all service and monetary benefits, including notional seniority, pay and allowances, by considering her representation dated 02.08.2019. 3.

When the writ petition came up before this Court for hearing, the learned Special Government Pleader appearing on behalf of the respondents therein submitted that the petitioner's representation had been forwarded to the third respondent therein/respondent herein and he had to pass orders on the petitioner's representation. Therefore, in view of the said submission, this Court, by order dated 11.09.2025, directed the third respondent therein to consider the petitioner's representation on merits and in accordance with law and pass appropriate orders within six weeks from the date of receipt of a copy of the order, after hearing the petitioner and aggrieved persons, if any.

Alleging non-compliance of the aforesaid order, the present contempt petition has been filed.

On 05.06.2026, this Court passed the following order in the contempt petition:

"Pursuant to the order of this Court dated 22.04.2026, issuing statutory notice to the respondent, Mr.M.Ramasamy, the Joint Director of School Education (Personnel), DPI, College Road, Chennai, appeared before this Court today.

2. Mr.B.Karthikeyan, learned Government Advocate appearing for the respondent/alleged contemnor submitted that the order under contempt has been complied with and he tendered an unconditional apology to this Court for the delay in complying with the order of this Court dated 11.09.2025 made in W.P.No.34259 of 2025 and prayed that the respondent/contemnor be purged of the contempt.

3. For filing report as to compliance, post the matter on 19.06.2026."

Today, M.Ramasamy, Joint Director of School Education (Personnel), DPI, College Road, Chennai-600 006 (the respondent herein), is present before this Court.

The learned Government Advocate appearing for the respondent submitted that the representation of the petitioner has been considered and the order of this Court has been fully complied with and he also produced a copy of the proceedings dated 17.06.2026 in Na.Ka.No.36517/A4/E3/2025 along with

the compliance report dated 19.06.2026. Though there had been a delay in complying with the order of this Court, it is submitted that the same was on account of administrative reasons and therefore, the respondent may be absolved of the charge of contempt.

Heard the learned counsel for the respondent/State and perused the records.

From the records, it is seen that the order of this Court has been complied with, of course, with delay and the delay in complying with the order of this Court, is condoned given the reason therefor. That apart, the respondent has also tendered his unconditional apology for the delayed compliance. In view of the above, recording the compliance, this contempt petition is closed. The respondent is directed to serve a copy of the proceedings dated 17.06.2026 in Na.Ka.No.36517/A4/E3/2025 on the petitioner. 19-06-2026 Index: Yes/No Speaking/Non-speaking order nsd
