in Crl.O.P.No.23982 of 2022 A.D.JAGADISH CHANDIRA,J.

This petition has been filed to extend the time for a period of four weeks to execute the sureties and comply with the condition imposed on the petitioner in Crl.MP.No.19935 of 2022 in Crl.OP.No.23982 of 2022 by an order dated 04.01.2022.

2. The learned counsel for the petitioner would submit that this Court, by an order dated 04.01.2023 in Crl.OP.No.23982 of 2022 has granted modification to the petitioner. However in the order copy, at the end of the Paragraph No.3, it has been wrongly typed as "and the sureties should be blood related sureties" and thereby the petitioner seeks to delete the blood related sureties in the order copy. He further submits that the petitioner was unable to execute the sureties and comply with the conditions as directed by this Court and hence seeks for extension of time.

3. Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed by this Court in Crl.MP.No.19935 of 2022 in Crl.OP.No.23982 of 2022 dated 04.01.2023 is modified as follows :

"3. Considering the above facts, this Court is 1/3

inclined to modify the condition to the effect that the petitioner shall deposit the title deeds of immovable property worth about Rs.10,00,000/- stands in the name of the petitioner or his relatives or his friends. Further, the encumbrance certificate of the said property for a period of 40 years, along with an affidavit of undertaking that no encumbrance will be caused over the said property till the proceedings are over". All the other conditions imposed shall remains intact.

4. Further, four weeks time is granted to the petitioner to execute the sureties and comply with the conditions as imposed by this Court, from the date on which the order copy made ready. Failing which, the order of granting anticipatory bail shall stand automatically dismissed. No further extension will be granted to the petitioner.

5. Registry is directed to carry out necessary amendment in Crl.MP.No.19935 of 2022 in Crl.OP.No.23982 of 2022 dated 04.01.2023 and issue fresh order copy.
