ORDER
By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
2. This petition has been filed for a direction, directing the respondents to consider the petitioners representation dated 13.8.2025 along with the communications dated 19.8.2025 and 24.9.2025 and consequently provide a pedestrian access pathway of at least three (3) feet width to the petitioners residential house situated in survey No.508/1,Chinnasalem Village, Chinnasalem Taluk,Kallakurichi Districtd by granting appropriate way leave/access facility in accordance with section 16 of the Railways Act 1989 and Railway Board circular dated 27.11.2001.
3. It is the case of the petitioner that the petitioner's residential pathway is blocked by the Railways, hence, the petitioner has made a representation to the first respondent on 13.08.2025, thereby, the first respondent has sent a communication to the fourth respondent seeking for consideration and passing appropriate orders, however, the same is pending for consideration. Hence, this writ petition.
4. The learned counsel for Railways submitted that the recommendation made by the first respondent/District Collector will be considered and
appropriate order(s) will be passed within a reasonable time fixed by this Court.
5. Heard both sides and perused the materials placed on record.
6. Considering the facts and circumstances of the case, this Court without going into the merits of case, directs the respondents 3 and 4 to consider the recommendation made by the first respondent/District Collector dated 19.08.2025 and 24.09.2025 with regard to the petitioner's representation dated 13.08.2025 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this Order.
