Respondent Prayer: Criminal Original Petition filed under Section 439(1)(b) of Criminal Procedure Code praying to set aside the order passed in Crl.M.P.No.4906 of 2020, dated 02.03.2020 by the learned District and Sessions Judge, Madras and consequently modify the condition in so far as the deposit of Rs.1,00,000/- imposed in the order dated 21.02.2020 by the learned Additional Chief Metropolitan Magistrate (E.O.-1), Egmore in Crl.M.P.No.32 of 2020.

O R D E R
(The case has been heard through video conference) Challenging the bail condition of the trial Court directing the petitioner to deposit Rs.1,00,000/-, the petitioner filed Crl.M.P.No.4906 of 2020 before the learned Principal Sessions Judge, Chennai seeking modification. The learned Principal Session Judge, Chennai by an order dated 02.03.2020, dismissed the said petition. Challenging the same the present Criminal Original Petition has been filed by the petitioner.
2. The petitioner has been implicated for the offence under Section 135 of the Customs Act in R.R.No.45 of 2019 on the file of the respondent police.
3. Heard the learned counsel on either side.
4. Considering the fact that the total amount of illegal import was around Rs.3.92 crores, the Court below has imposed a condition that the petitioner shall deposit Rs.1,00,000/-. I do not find any illegality in imposing the said condition. Hence this petition is dismissed. At the request of the learned counsel appearing for the petitioner, four weeks time 2/4
is granted to deposit the said amount from the date on which the order copy is made ready.
