Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 20.12.2014 within a time framed by this Hon'ble Court to direct the third respondednt to pay all retirement and pension benefits to the petitioner. Heard both sides. By consent of both the parties the writ petition is taken up for final disposal.

2.The prayer sought for in the writ petition is a direction to the third respondent to pass orders on the representation of the petitioner dated 20.12.2014 to pay pension and terminal benefits. 3.A counter affidavit is filed by the respondents stating that the petitioner was convicted by a criminal Court in the Vachathi case. Based on such conviction, he was removed from service. Now https://hcservices.ecourts.gov.in/hcservices/

the petitioner has filed appeal against the conviction and unless the appeal is decided in his favour, the petitioner could not seek for pension and other terminal benefits.

4.In view of the same, the writ petition fails and the same is dismissed. No costs.
