P.Shanmugam v. The Authorised Officer,

2023-08-01Honourable Mr Justice R. Mahadevan,Honourable Mr Justice Mohammed Shaffiq2 pages

W.M.P.No.7110 of 2023 IN Rev. Aplw. SR.No.117467 of 2018 R.MAHADEVAN, J.

AND MOHAMMED SHAFFIQ, J.

(Order of the court was made by R.Mahadevan, J.) This miscellaneous petition has been filed by the petitioners seeking to condone the delay of 1508 days in re-presenting the above review petition.

2. We perused the affidavit filed in support of this petition, wherein, it has been stated that the review petition that was filed on 12.10.2018, was returned by the Registry for some correction on 29.10.2018 and the same was not re-presented by the erstwhile counsel. It is also averred that since the previous counsel did not take any steps to re-present the papers, the petitioners have given change of vakalat and engaged the present counsel. Thus, the delay occurred is neither wilful nor wanton and therefore, the same may be condoned.

3. Having regard to the reasons stated by the petitioners, which appear to be bonafide, considering the huge delay in filing the review petition, we are inclined to condone the delay subject to payment of costs of Rs.2,000/- by the petitioners to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, within a period of two weeks from the date of receipt of copy of this order.
