[Order of the Court was made by RAJIV SHAKDHER,J.] 1.
Pursuant to our last order dated 13.11.2017, a Memo has been filed by the Superintendent of Police, which is dated 21.11.2017. The said Memo inter-alia is indicative of the fact that the surgery of the detenu was performed on 18.11.2017. 2.The petitioner's grievance in the present petition interalia was that the detenu had fractured his leg and therefore, it required surgery, which was not performed.

Since, surgery has been performed, the learned counsel for the petitioner says that he does not wish to press the petition, and thus, seeks permission to withdraw the petition. The learned counsel has also made an endorsement to that effect. 4.
Accordingly, the captioned petition is dismissed as withdrawn.

We may also note that as directed by us, on 13.11.2017, Mr.D. Pazhani, Superntendent of Prison, Central Prison, Cuddalore is present in Court.
