The petitioners seek Anticipatory Bail apprehending arrest in Crime No.69 of 2019. The First Information Report has been registered under Sections 147, 294(b), 353, 506(ii) IPC and Section. 4 of the Tamilnadu Prohibition Harassment Women Harassment Act r/w Section 131(2), 132(3) of the Representation of People Act.

2. A perusal of the First Information Report shows that the overt acts complained as against the petitioners are not very serious in nature. The respondent police has also issued a notice under Section 41(a) requiring the accused persons to appear before them on 27.04.2019 at 10 am. Since the accused/ petitioners were not present, notice has been served by affixture. It is stated that the petitioners have not appeared.

Considering the fact that the allegations made against the petitioners are not very serious in nature and the fact that the offences alleged are stated to have been happened during elections, I am of the considered opinion, the petitioners are entitled to Anticipatory Bail. http://www.judis.nic.in

Accordingly, this petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of the order, before the learned Judicial Magistrate No.1 Ramanathapuram, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, as the case may be. The petitioners shall co-operate with the investigation and appear before the respondent Police as and when required for interrogation.
