(Order of the Court was made by The Hon'ble Chief Justice) Having heard learned counsel for the petitioner and Sri.Purushothaman, learned counsel for the first respondent Caveator, we find that the reasons given in support of the delay condonation

application are sufficient to condone the delay. Accordingly, the delay is condoned and the petition is allowed.

The appeal shall be treated to be within time and be given the regular number.
