O R D E R

The petitioner, who was arrested and remanded to judicial custody on 22.12.2025 for the alleged offence punishable under Section 105 BNS 3, 5(n), 5(j)(ii) and 6(1) r/w.17, 21(1) of POCSO, in Crime No.59 of 2025 on the file of Respondent Police, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is the sister's husband of the victim girl. Taking advantage of the crime and as the victim girl is aged about 16 years, the petitioner committed aggravated penetrative of the sexual assault which resulted in pregnancy. Hence, the case was registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is in incarceration from 22.12.2025 and he is ready to co-opearate for the investigation. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the DNA report is awaited and hence final report yet to be filed. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the fact that the petitioner had already married the person and had committed aggravated penetrative of sexual assault and DNA report is also awaited and statement of the victim girl also implicates the petitioner, this Court is not inclined to grant bail to the petitioner. 2/4
