ORDER
The writ petition has been filed seeking a mandamus to the respondents to consider the representation of the petitioner dated 29.12.2025.
2. The petitioner would submit that his father C.Chandrappa died in harness on 28.04.2021 while he was in service as Night Watchman at Thally Panchayat Union, Krishnagiri, leaving behind his wife Muniyamma and his two sons. The petitioner is his elder son and his younger son is Santhosh Kumar. Claiming disbursement of death benefits of his father, the petitioner's younger brother had submitted a representation to the respondents on 12.06.2023. Since no orders have been passed by the respondents, the petitioner had submitted one more representation on 29.12.2025. However, the same is also not considered till date. Hence, the petitioner is before this Court.
3. The petitioner would submit that though his father had joined the services initially on NMR pay roll in the year 2002, he was promoted to the post of Night Watchman on 26.06.2008 and his scale of pay was revised and refixed as per G.O.Ms.No.234 Finance (Pay Cell) Department dated 01.06.2009.
Hence, the present representation was filed seeking disbursement of Special Provident Fund (SPF), Earned Leave, Unearned Leave and CPS and arrear of pension, based on the refixation of pay.
4. The grievance of the petitioner is that his father who is a Government servant had died in the year 2021 and even after a lapse of 4 1/2 years, his family members are not able to avail the benefits, which they are entitled to.
5. Heard the learned counsel on either side and also perused the materials placed before this Court.
6. Considering the facts and circumstances of the case and also the limited scope of prayer sought for in this writ petition, this Court without going into the merits of the case, directs the respondent concerned to consider the representation of the petitioner and pass orders within a period of three weeks from the date of receipt of a copy of this order.
