ORDER

This Writ Petition has been filed seeking issuance of a Writ of Certiorari to call for the records relating to the Provisional Assessment Order dated 04.12.2025 passed by the respondent in respect of Electricity Service connection No.142-045-118/IA and to quash the same.

2. The case of the petitioner is that she obtained electricity service connection for her house in the year 2017 bearing E.B. Service Connection No.142-045-118/1A. While so, on 04.12.2025 at about 11.45 a.m., the respondent herein, along with other officials, conducted an inspection of the said electricity service connection and informed that the petitioner and her husband misused the electricity connection for "JAIRO Party Function Hall" on the second floor of the house. Consequently, a provisional assessment was made and extra levy charges of Rs.52,556/- was imposed. Challenging the same, the present Writ Petition has been filed.

3. The learned counsel for the petitioner submitted that the petitioner is willing to pay the penal amount of Rs.52,556/- in installments, without pursuing further litigation and prayed for appropriate orders.

4. In view of the above submission, without going to merits of the case, this Court directs the petitioner to pay the provisional assessment amount of Rs.52,556/- (Rupees fifty two thousand five hundred and fifty six only) in five installments as follows:

i) The petitioner shall pay the first installment of Rs.12,556/- (Rupees twelve thousand five hundred and fifty six only) commencing from this month.

ii) The remaining four installments shall be paid at Rs.10,000/- (Rupees ten thousand only) each per month thereafter. iii) In the event of default in payment of any one of the installments, the respondent is at liberty to initiate appropriate proceedings in accordance with law.
