Securities Of K.Aravamudhan v.
O.P.No.290 of 2014 K.RAVICHANDRABAABU., J This Petition has been filed under Section 372 of the Indian Succession Act, 1925 and Order XXV Rule 6 of O.S.Rules to grant succession certificate in favour of the petitioners.
2. The petitioners are sisters and the second petitioner is represented by the first petitioner by virtue of an Instrument of Power of Attorney dated 27.11.2013 executed and notarized at the United States of America. The deceased K.Aravamudhan (alias) K.A.Amudhan who is the father of the petitioners, ordinarily resided at No.13, Kumar Moon Stone Apartments, Second Main Road, Kasturba Nagar, Adayar, Chennai - 600 020. He died on 23.03.2013, when he made a visit to his daughter's house in Santa Ana, Country of Orange, California State, United States. The deceased died intestate leaving behind him, the petitioners alone as his surviving Class-I legal heirs. The wife of the deceased, predeceased him long ago. The petitioners as the daughters of the deceased claims to be entitled to the share of the estate. The petitioners herein have filed the present petition for grant of succession certificate in favour of the petitioner with power to
collect the debts and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule to the petition.
3. Mr.Kannan Mohan, the brother of the deceased K.Aravamudhan (alias) K.A.Amudhan, who was authorised by the petitioners has examined himself as P.W.1 and marked Exs.P.1 to P.6 viz., Ex.P.1 :
Original authorization letter dated 28.06.2014 given by the first petitioner to Mr.Kannan Mohan to give evidence before this Court.

Original authorization letter dated 08.07.2014 given by the second petitioner to Mr.Kannan Mohan to give evidence before this Court.

Original death certificate of the deceased Aravamudhan, (petitioners father) who died on 26.03.2013 Ex.P.4 :

dated 24.06.2014 He has further stated in his evidence that he has not filed any other petition before any other Court seeking the same relief.

Considering the averments made in the petition and the documents filed by the petitioners, I am satisfied that the petitioners have succeeded the Estate of the deceased K.Aravamudhan (alias) K.A.Amudhan. Therefore, the petition is ordered as prayed for and a direction for grant of Succession Certificate to the petitioners with powers to collect the debts and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule to the petition is issued.
