PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the above mentioned condition in para no.4 imposed by this Court in Crl.O.P.No.12 of 2025 dated 06.01.2025. For Petitioner(s):

ORDER

The petitioner is in custody from 28.11.2024, and he was granted bail by this Court by an order dated 06.01.2025 in Crl.O.P.No.12 of 2025, seeking modification of condition directing him to produce a blood relative as a surety.

2. The learned counsel for the petitioner submitted that the petitioner has no blood relative, and in view of the same, the petitioner is unable to comply with the condition and still is languishing in jail and sought modification of the condition in para no.4 imposed by this Court in Crl.O.P.No.12 of 2025 dated 06.01.2025.

3. Heard the learned Government Advocate (Crl.Side) for the respondent.

4. Considering the fact that the petitioner is still in custody and unable to produce blood-related surety, this Court is inclined to modify the Page No.2 of 5

condition to the effect that "the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties (both sureties shall be local residents), each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvottiyur. The other conditions imposed in the order dated 06.01.2025 in Crl.O.P. No.12 of 2025 shall remain unaltered.

5. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.

6. Accordingly, the criminal miscellaneous petition is ordered, and the condition is modified.
