Learned Judicial Magistrate, Tiruchengode, to take up the Final Report/Charge Sheet No.646/2016 in respect of the F.I.R. 390/2015 on the file of the Pallipalayam Police Station, and proceed in accordance with law under Section 209 of the Criminal Procedure Code and thereby commit the case to the court of Sessions at Namakkal. This Writ Petition has been filed seeking a direction to the learned Judicial Magistrate, Tiruchengode, to take up the Final Report/Charge Sheet No.646 of 2016 in respect of the F.I.R. In Crime No. 390 of 2015 on the file of the Pallipalayam Police Station, and proceed in accordance with law under Section 209 of the Criminal Procedure Code, thereby committing the case to the Court of Sessions at

The learned Government Advocate (Crl.Side) appearing for the respondents 1 to 3 submitted that the investigation in Crime No.390 of 2015 is still pending and that no charge sheet has been filed before any Court. He further submitted that though the investigation has been completed in Crime No.390 of 2015, the charge sheet is yet to be filed.
3. In view of the above, the direction sought for in this petition cannot be considered. Accordingly, this Writ Petition stands dismissed. However, the third respondent is directed to complete the investigation and file final report within a period of four (4) weeks from the date of receipt of a copy of this order.
