IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 15.03.2018

CORAM:

THE HON'BLE MR.JUSTICE T.RAJA Contempt Petition No.442 of 2018 Nattar Ilayapillai Primary School rep. by Manager, Ammapettai Vadakanannthal, Villupuram District-606 207.

... Petitioner Vs.

Thiru Santhappan, Assistant Elementary Educational Officer, Ammapettai, Villupuram District.

... Respondent This Contempt Petition is filed to punish the respondent for willfully and wantonly disobeying the order of this Court dated 25.06.2015 in M.P.No.1/2015 in W.P.No.18246 of 2015.

For Petitioner : Mr.S.N.Ravichandran For Respondent : Mrs.P.Rajalakshmi, Additional Government Pleader

O R D E R

Alleging the violation of the orders of this Court dated 25.06.2015 made in M.P.No.1/2015 in W.P.No.18246 of 2015, the present contempt petition has been filed.

2.

When the matter is called, the learned Additional Government Pleader appearing for the respondent by producing a Proceedings of the respondent dated 14.3.2018 submitted that the order of this Court made in M.P.No.1 of 2015 in W.P.No.18246/2015 dated 25.6.2015 has been complied with by giving temporary approval for a period of 5 years from the date of appointment of one Tmt.P.Radha as a Secondary Grade Teacher in the petitioner's school. Therefore, when the said Radha was appointed on 30.4.2012 as per the direction given by this Court, approval was granted only for 5 years i.e. till 30.04.2017. 3.

However, the learned Counsel for the petitioner submitted that in view of the subsequent development in extending the time to pass the Teachers Eligibility Test by 31.03.2019 by the Union of India that period of 5 years has automatically be extended till 31.3.2019.

4.

I find some merit in the said submission of the learned Counsel for the petitioner 5.

Therefore, the respondent shall consider the case of the petitioner for releasing the salary of Tmt.P.Radha, who is working as Secondary Grade Teacher in the Petitioner's School, till 31.3.2019, the maximum outer limit for passing of the Teachers Eligibility Test.

6.

With the above direction, the Contempt Petition is disposed of.
