Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the fourth respondent to consider the petitioners' representation dated 19.10.2023 and issue patta in favour of the petitioners in respect of the lands owned by the petitioners in Survey Nos.370A/16, 370A/1B7 and 370A/1B8 measuring an extent of 58 cents situated at Valayapatti Village, Mohanur Taluk, Namakkal District, within the time limit to be fixed by this Court. This writ petition has been filed seeking issuance of a writ of mandamus directing the fourth respondent to consider the representation made by the petitioner on 19.10.2023 wherein the petitioners have sought for issuance of patta in their names with respect to the subject property.

2. Heard Mr.C.Jagadish, learned counsel for petitioners and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing for respondents.

3. The petitioners are claiming right and title over the subject property on the ground that they inherited the property from the predecessor in title. Originally, the father of the petitioners had sought for patta and since the same was not granted, they filed civil proceedings. The civil proceedings came to be disposed of on the ground that the patta can be sought for only by making an application before the revenue authorities. Accordingly, an application was submitted seeking for patta by the father of the petitioners. Unfortunately, he died and thereafter, the petitioners made a representation dated 19.10.2023 seeking for patta in their names with respect to the subject property. On receipt of the representation, the fourth respondent also called the petitioners for an enquiry through communication dated 03.02.2024. Thereafter, there was no progress and hence, the present writ petition has been filed before this Court seeking for appropriate directions.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the fourth respondent to pass orders on the representation made by the petitioners seeking for patta with respect to the subject property within a period of six (6) weeks from the date of receipt of a copy of this order. 3/4
