Order : This Miscellaneous petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.NEELAKANDAN, Additional Advocate General Assisted by M/S.T.SEENIVASAN, Advocate for the petitioner and of M/S.M.A.ABDUL WAHAB, Advocate for the 1st Respondent, the court made the following order:- This Civil Miscellaneous Petition has been filed, to condone the delay of 1736 days in filing the above writ appeal.
2. Considering the averments made in the petition, this petition is allowed on condition that the appellant pays a sum of Rs.50,000/- [Rupees Fifty Thousand Only] out of which Rs.25,000/- (Rupees Twenty Five Thousand Only) to the Anandam Home for Senior Citizens, Anna Street, Gangai Nagar, Kallikuppam, Ambattur, Chennai 600 053. Mobile Nos.9444953268 / 9710446131 and balance amount of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the writ petitioner on or before 10.06.2022, failing which, petition to condone the delay, would stand dismissed, without further reference to this Court.
3. On payment of costs within the stipulated period and production of receipt, Registry is directed to number the Writ appeal, if it is otherwise in order and post the same for admission.
4. C.M.P.No.5188 of 2022 is ordered, accordingly.
