JUDGMENT

Today, when the matter was taken up for hearing, Mr.A.Muthu kumar, learned counsel for the appellant and Mr. A.Muthu kumar, learned learned counsel for the first respondent, Mr.B.Jawahar, learned counsel for the respondents 3 to 6 and Mr.P.Srividhya, learned counsel for the respondents 7 to 10 submitted that the appellant have settled the dispute amicably between themselves by entering into a joint memo of compromise, today. The learned counsel for the respondent further submitted that the appellant is bed-ridden and permission is granted by this Court to his wife and daughter to represent the appellant on his behalf and the same is also recorded. Hence, according to them, this appeal suit may be disposed of in terms of the said joint memo of compromise.

The joint memo of compromise dated 08.12.2023 has been produced before this Court, from a perusal of which, it is seen that that the same has been signed by the appellant and the respondents and their 2/4

respective counsel as well.

3. The memo of compromise dated 08.12.2023 signed by the respective parties and their respective counsel is taken on record. In the light of the compromise memo, this Second Appeal is dismissed as settled out of Court. The compromise memo shall form part of the order.

4. The Registry is directed to furnish the certified copy of the order within two weeks and directed to send back the trial records immediately without any delay. Consequently, connected miscellaneous petition is closed. No cost.
