ORDER
This Writ Petition has been filed to rectify the FMB sketch for the property morefully described in the prayer to this writ petition, and thereafter issue patta in favour of the petitioner for the correct extent of land based on the petitioner's representation, dated 04.07.2024, within a time frame to be fixed by this Court.
2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents.
3. The petitioner claims that there is an error in the FMB sketch for the property morefully disclosed in the prayer to this writ petition. According to the petitioner, the extent of land has been wrongly disclosed. He seeks for correction of the FMB sketch and thereafter for issuance of patta in his name for the correct extent of the land. He had Page No.2 of 6
given a representation on 04.07.2024 along with the supporting documents for the aforesaid purpose. Since the same was not considered, the petitioner has filed this writ petition.
4. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner and after hearing the objections, if any, from all the necessary parties, whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court.
5. This Court is not expressing any opinion on the merits of the petitioner's representation.
6. For the foregoing reasons, this Writ Petition is disposed of by directing the 2nd respondent to pass final orders, on merits and in accordance with law, on the petitioner's representation, dated 04.07.2024 seeking for rectification of the FMB sketch for the property morefully disclosed in the prayer to this writ petition, and thereafter issue patta in the name of the petitioner for the correct extent of land, after giving due Page No.3 of 6
consideration to the supporting documents filed by the petitioner and after hearing the objections, if any, from all the necessary parties, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
