O R D E R

1. This is a petition, which seeks to challenge the detention order dated 26.09.2017.
2. A perusal of the detention order would show that three (3) adverse cases are noticed qua the detenu. These being : Crime No.50 of 2016; Crime No.63 of 2016; and Crime No.102 of 2017. In respect of all the cases, the detenu has been booked under various provisions of the ITP Act. 2.1.Furthermore, the record shows that the subject case has been registered as Crime No.103 of 2017. In this case as well, the detenu has been booked under the provisions of the ITP Act. In addition thereto, the record also shows that the detenu was arrested on 14.09.2017.
3. Given this background, we have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor. We have also perused the record. According to us, the impugned detention order cannot be sustained for the following reasons:
(i) First, though the detenu was arrested on 14.09.2017, the impugned order was passed on 26.09.2017. Notice in this petition was issued on 14.11.2017, despite which, no counter affidavit has been filed by the State. Resultantly, the delay in passing the impugned order remains unexplained. (ii) Second, the Detaining Authority, in our view, wrongly entertained an apprehension that the detenue may be released on bail, even while noticing the fact that bail applications filed in Crime No.50 of 2016; Crime No.63 of 2016; Crime No.102 of 2017; and crime No.103 of 2017 were pending, on the date when the impugned order was passed. A perusal of the impugned order shows that this conclusion, though erroneous, was reached, based on the result obtained in another case, i.e., Crime No.36 of 2017. Pertinently, there is a reference to the number of the bail application moved in Crime No.136 of 2017, but the date of the order is not set forth in the detention order.
4. Thus, for the foregoing reasons, as indicated above, we are inclined to quash the impugned order. It is directed accordingly.
5. In the result, the Habeas Corpus Petition is allowed and the order of detention in No.593/BCDFGISSSV/2017 dated 26.09.2017, passed by the second respondent is set aside. The detenu, namely, Abbas @ Vaseegaran @ Mohan Babu, S/o.Selvaraj, male, aged about 34 years, is directed to be released
forthwith unless his detention is required in connection with another case. Given the nature of the case, this order will be communicated to the concerned Jail Superintendent by the Registrar General of this Court via Fax. (R.S.A., J.)
