For Petitioner in all W.P.'s : Mr.V.Raghavachari for Mr.M.Rajendiran For Respondents in all W.P.'s : Mr.P.Baladhandayutham, Special Government Pleader COMMON ORDER The writ petition in WP.No.9188 of 2121 is filed to issue a Writ of Certiorarified Mandamus calling for the records of the impugned order in Na.Ka.No.280/2020/A3 dated 24.10.2020 passed by the first respondent and quash the same and consequently to direct the first respondent to issue Sub-Division of patta, from patta No.974 comprising in Survey No.11/4 measuring 1200 sq.ft. Plot No.5 situated at No.55, Kaspapuram Village, Tambaram Taluk, Chengalpet District.

2. Heard, Mr.V.Raghavachari, the learned counsel for the petitioners and Mr.P.Baladhandayutham, Special Government Pleader appearing for the respondents.

WP.No.9188 of 2021

3. The petitioner has purchased the property comprised in survey Nos.11/1A, 11/2, 11/3 and 11/4 and others situated at Kaspapuram Village, Tambaram Taluk, Chengalpet District. The said property originally belonged to one, Subramaniya Devar who had got the property vide document No.4547 of 1968 dated 12.10.1968. The land has been taken by the Government vide GO.No.781 dated 12.03.1965 as per the Tamilnadu Inam Estate (Abolition and Conversion into Ryotwari) Act 26 of 1963 and classified as 'Anadheenam' by the Settlement Officer and entry made in the settlement register, without giving any opportunity to the predecessor in title. The land owner has verified the SLR copy obtained from the District Collector, Kancheepuram and made representation before the second respondent for change of classification. However, the representation was rejected by the second respondent for issuance of patta on the ground that the application has been filed belatedly by its order dated

27.12.2010 and also the second respondent has no powers to condone the delay. Aggrieved by the same, the predecessor in title had filed writ petition before this Court in WP.No.10485 of 2011 and this Court by order dated 25.04.2011 set aside the order passed by the second respondent and remanded back to the second respondent for fresh disposal.

3.1. As directed by this Court, the second respondent conducted enquiry and on receipt of the report from the Revenue Authorities, the first respondent and others and also recorded the statement and passed order as per Section 9(1) (a) and 12 of the Tamilnadu Inam Estates (Abolition and Conversion into Ryotwari) Act, 26 of 1963 dated 23.09.2011 in the proceedings SR 05/2011/CE2/6269/2011, thereby ordered that the land owner is entitled to get patta for the subject property as the same was wrongly classified as 'Anadheenam'. Further directed the first respondent to make necessary changes in the Taluk and Village Accounts in favour of the land owner. Thereafter, land owner has approached revenue authorities to carry out necessary changes in the Village and Taluk Accounts and also for issuance of patta.

However, the first respondent did not issue any patta and as such again the land owner approached this Court in WP.No.32687 of 2012. This Court by order dated 14.12.2012. directed the first respondent to implement the order passed by the second respondent and accordingly the first respondent passed the order on 30.01.2013 by its proceedings Na.Ka.399/2011/A5 and issued patta in patta No.974. Thereafter the land owner formed layout consisting of 36 house plots vide plan permit No.1028/2013 and the entire house plots have been sold out to the individuals. The petitioner is a purchaser as like others and after purchasing the plots, he raised loan and put up construction. Thereafter, he is living peacefully without any hindrance.

He was also provided roads, drinking water, drainage and other basic amenities from all the Departments and his house is also assessed to property tax. Thereafter, the petitioner has applied for sub division of patta before the first respondent herein. His request has been rejected by the order impugned in the writ petition.

On perusal of the counter filed by the first respondent, revealed that the subject property comprised in survey Nos.11/CA to an extent of 0.13.5 ares, survey No.11/2 to an extent of 0.11.0 ares, survey No.11/3 to an extent of 0.23.5 ares and the land comprised in survey No.11/4 to an extent of 0.12.0 ares situated at Kaspapuram Village, Tambaram Taluk, subjected for change of classification before the second respondent from Anadheenam to Ryotwari patta. The said request was considered and the second respondent passed order on 30.01.2013 thereby changing the classification from Anadheenam

to Ryotwari patta land and consequently directed the first respondent to change the Village Accounts accordingly. According to the provisions under Section 11(3) of the Tamilnadu Inam (Abolition and Conversion into Ryotwari) Act, against a decision by a settlement officer during the settlement, any person aggrieved by such decision may, within three months from the said date, appeal to the Tribunal. The subject lands were declared as Anadheenam by the Settlement Tahsildar, Chengalpet by order dated 31.01.1969.

4.1 The predecessor in title ought to have preferred appeal before the Tribunal within a period of three months from 31.01.1969. However, he did not prefer any appeal as provided under the said Act. At least he should have utilised the concenion granted by the Government to obtain ryotwari outside the scope of aforesaid act by preferring claim for patta in accordance with GO.Ms.No.370 CT and RE Department dated 03.10.1974 and the GO.Ms.No.1889, CT and RE Department dated 24.12.1976 extended upto 31.03.1977. However, the predecessor in title did not choose to prefer any claim for grant of ryotwari patta for the subject lands. On the existing of the last date of 31.03.1977, the authorities of the Government including settlement authorities are not competent to entertain and pass orders on time barred claims.

Therefore, the order passed by the second respondent dated 03.09.2011 passed by the second respondent is not valid. There is no provision available under the Tamilnadu Inam (Abolition and Conversion into Ryotwari) Act to change the decision made during the settlement by any other authority except to prefer an appeal before the Tribunal under Section 11(3) of the said Act. In view of the said legal position, the petitioner is not entitled for any sub division of patta.

Initially the predecessor in title made representation before the second respondent for rectification of classification and the same was rejected by order dated 27.12.2010 in proceedings Na.Ka.E2/17067/2011. It was challenged before this Court in WP.No.10485 of 2011 and this Court set aside the said order passed by the second respondent on 25.04.2011 and remanded back to the second respondent for fresh disposal after giving opportunity of hearing. The second respondent conducted detailed enquiry on receipt of the report from the revenue authorities and also recorded the statement from the revenue authorities and passed order dated 23.09.2011, thereby declared that the land owner is entitled to get patta for the subject property and also stated that the classification as 'Anadheenam' was wrongly classified and directed to make necessary changes in Taluk and Village Accounts as ryotwari patta in favour of the predecessor in title.

In fact, this Court in WP.No.32687 of 2012 by order dated 14.12.2012, directed the first respondent to implement the order passed by the second respondent and accordingly the first respondent ordered to issue patta to the predecessor in title and accordingly issued patta in patta No.974. Thereafter, the predecessor in title formed layout in respect of the subject land and divided into house plots. All the house plots have been sold to various third parties including the petitioner herein. Therefore, now the first respondent cannot say that the second respondent has no power to order for reclassification from 'Anadheenam' to the 'Ryotwari patta land'. This Court set aside the order passed by the second respondent and remanded back to the second respondent for fresh disposal. Therefore, the petitioner is entitled for sub division as per his sale deed and entitled for patta.

7. In view of the above, the impugned order dated 24.10.2020 passed by the first respondent is liable to be set aside. The other writ petitions in WP.Nos.9190, 9198, 9206, 9212, 9215, 9218, 9222, 9228, 9232, 9235, 9239, 9244, 9247, 9252, 9255, 9259, 9263, 9269, 9278, 9281, 9285, 9290, 9295 & 9299 of 2021 are also filed challenging the orders passed by the first respondent, thereby rejecting the petitioners' request for sub division of patta. The facts are identical and similar to the facts that was dealt in W.P. No.9188 of 2021 and the properties are also situated at No.55, Kaspapuram Village, Tambaram Taluk, Chengalpet District. The respective patta numbers, survey numbers and the plot numbers in respect of the petitioners are given below:

8. Accordingly, the impugned orders challenged in all the writ petitions are hereby quashed. The first respondent is directed to sub divide the subject properties as per the petitioners' respective sale deeds and settlement deeds and order to issue patta in their favour within a period of four weeks from the date of receipt of copy of this order.

9. Accordingly, all the writ petitions are allowed. Consequently, connected miscellaneous petitions are closed. No order as to costs.
