A.No.1446 of 2021 A.No.1446 of 2021 in C.S.No.307 of 2020 SENTHILKUMAR RAMAMOORTHY,J This application is filed by the first defendant in the suit to delete it from the array of parties. The applicants states that the suit proceeds on the misconception that the applicant / first defendant owns / exercises control over the second defendant. The first respondent / plaintiff has filed a counter affidavit dated 18.04.2022 stating that it has no objection to the deletion of the first defendant from the array of parties because the necessary party has been impleaded.
2. Upon consideration of the above submissions and on examining the affidavit and counter affidavit, this application is liable to be allowed since the first defendant is neither a necessary nor proper party. Accordingly, A.No.1446 of 2021 is allowed. As a consequence, the plaintiff is directed to carry out amendments to the plaint on or before 29.04.2022. An amended copy of the plaint shall be served on the remaining defendant on or before 06.06.2022.
