Applicant is the 1st defendant.

The suit summon was received on 19.01.2021 and thereby, the written statement has to be filed within 30 days from the receipt of the suit summon i.e., on 18.02.2021. Whereas, the written statement was filed only on 15.03.2021 with the delay of 25 days.

2. The 1st defendant in the affidavit has stated that due to COVID 19 Pandemic situation, there was a limitation in the functioning of the defendant's office. Therefore, the written statement could not be filed in time.

3. The reasons stated above appears to be genuine. Hence the delay of 25 days is condoned.

4. Call the matter on 23.06.2021.
