JUDGMENT

(Order of the Court was made by S.TAMILVANAN,J.) Learned counsel appearing for the appellant/accused submits that the appellant Ramalingam is no more.

2.In the previous hearing, learned Additional Public Prosecutor sought time for getting instructions to verify the death of the

appellant.

3.Today, when the matter is called, the learned Additional Public Prosecutor admitted the factum that the appellant is no more. 4.Though the date of death is not mentioned, there is no supporting document and there is no rival plea about the death of the appellant, we are of the view to record the factum of death of the appellant and to dismiss the appeal. In the result, the appeal is dismissed as abated.
