Writ Petition filed under Article 226 of the Constitution of India seeking for a Writ of Mandamus, directing respondent No.1 to issue appropriate directions to the second respondent to implement its interest subsidy scheme and grant waiver of interest for the education loan taken by the petitioner and also consider the representation of the petitioner, dated 25.03.2015, and impose simple interest for loan amount during the course period. By consent, the Writ Petition is taken up for final disposal.

The petitioner claims that he belongs to an economically weaker section of the Society, and obtained educational loan from the second respondent during the Academic year, 2008, to pursue Bachelor of Engineering (Computer Science). Loan was sanctioned and the second respondent also agreed to pay a sum of Rs.60,000/- annually towards tuition fees. The petitioner would further state that the second respondent has stated that interest would be charged at the rate of 14.75% per annum. The petitioner, after successfully completing his Course, could not be placed in the job. In spite of the position being thus, he was forced to pay entire interest arrears, prior to the release of the annual fee. 3.

The grievance expressed by the petitioner is that, the second respondent is not in a position to provide interest subsidy, provided by the first respondent, and in this regard, the petitioner submitted a representation, dated 25.03.2015 to the respondents. Since he has not favoured with any response, he came forward to file this Writ Petition.

Heard Mr.R.Alvin Manoj Ra, the learned counsel appearing for the petitioner and Mr.Christopher Kishor Vincent, learned Assistant Central Government Standing Counsel for first respondent/Ministry of Human Resource Development. Considering the nature of order that is to be passed in this Writ Petition, this Court is of the view that the second respondent need not be served with any notice.

This Court, without going into the merits of the representation made by the petitioner, directs the second respondent to consider the petitioner's representation dated 25.03.2015, in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
