O R D E R

This writ petition has been filed for issuance of a writ of mandamus to direct the respondent to pay the petitioner interest at the rate of 18% per annum for the period of delay from 01.08.2022 to 11.06.2023 in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity and Encashment of leaves.

In the affidavit filed in support of the writ petition, it had been contended that the petitioner had been appointed as Conductor in the respondent Corporation on 22.06.1995 and retired from service on Voluntary Retirement on 31.07.2022. It is contended that EPF Employee's Contribution, Gratuity and Encashment of leave were paid with much delay on 11.06.2023. Interest is sought for such delayed payment.

3. Heard both sides and perused the materials available on record. 2/4

A direction is issued to the respondent to examine the Service Register of the petitioner and examine the facts about the date of payment of the aforementioned benefits and pay interest @ 6% p.a. from the date of voluntary retirement till the date of actual disbursement. Such disbursement should be made within a period of three months from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs.
