Respondent Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, praying to direct the Court of Sessions at Chennai to extend time for furnishing sureties passed in Crl.M.P.No.14023 of 2017 dated 15.09.2017 passed by the Court of Sessions at Chennai, in so far as furnishing two sureties to the satisfaction of the Fast Track Court-III, Saidapet, Chennai within two weeks from the date of order.

It is represented that the order dated 15.09.2017 in Crl.M.P.No.14023 of 2017 in C.A.No.256 of 2017 by the learned Session Judge, Chennai, is claimed to be received by the petitioner only on 26.09.2017. However, since there was a condition that the petitioner shall furnish two sureties within a period of two weeks from the date of the order i.e., 15.09.2017, the petitioner expressed his inability to furnish sureties within the time. The delay in making a copy of order cannot be attributed to the petitioner. http://www.judis.nic.in

2. The learned counsel for the petitioner submits that though the petitioner had four days time to furnish sureties, due to dasara holidays the petitioner could not able to procure sureties in time and therefore, sought for further extention of time.

3. I am of the view that a sympathetic view can be taken in this present petition. In the result, the criminal original petition stands allowed. Consequently, in continuation to the order dated 15.09.2017, in Crl.M.P.No.14023 of 2017 in C.A.No.256 of 2017 passed by the learned Session Judge, Chennai, the petitioner has granted further time of ten days from the date of the receipt of a copy of this order to furnish sureties to the satisfaction of the learned Fast Track Court-III, Saidapet, Chennai.
