This Civil Miscellaneous Petition has been filed to strike off the name of 14th respondent from the cause title in the above Second Appeal as she was incorrectly arrayed as party to the appeal proceedings.

2. Mr. P.M.Duraiswamy, learned counsel for petitioner would submit that on perusal of case papers, it is seen that one Mariammal/14th respondent was projected as wife of deceased Mariappan/2nd respondent and she has been substituted as legal representative of deceased 5th defendant. However, his vendor Anthonyammal was the wife of 5th defendant and she expired on 19.01.2012. While so, the person named Mariammal has been incorrectly arrayed as 14th respondent substituting her as legal representative of deceased 5th defendant in the above Second Appeal. Hence, it is just and necessary to strike off 14th respondent from the cause title. Accordingly, this petition has been filed.

3. Ms.R.Swathi, learned counsel for respondents appeared and submitted that she had no objections in allowing this petition.

4. Considering the facts and circumstances of the case, this petition is ordered. Registry is directed to strike off the name of 14th respondent from cause title and carry out the necessary amendment and post the matter on 24.04.2025 for arguments.
