Defendants Civil Suit filed under Section 92 of CPC read with Order IV Rule 1 OS Rules and Order VII Rule 1 of CPC praying for the following judgment and decree as follows:- a) For a declaration that the 2nd defendant is not entitled to function as trustee of 3rd Defendant Trust.

b) Directing the 2nd defendant to render accounts of the 3rd defendant trust for the period from March 2020.

c) For formation of scheme by this Court to manage the 3rd defendant trust.

d) Permanent injunction restraining the defendants 1 and 2 their men, agent, representatives from alienating and encumbering the rust properties in any manner whatsoever;

e) for cost of the suit.

JUDGMENT

The learned counsel for the plaintiffs by way of a Memo would indicate that the matter has been settled between the parties. The joint memorandum of compromise was filed before the Hon'ble Division Bench of this Court and the appeal itself was disposed of in terms of the Joint memorandum of compromise.

Recording the same, the present suit is disposed of as settled between the parties. The memo filed by the plaintiffs shall form part of record.
