This Criminal Miscellaneous Petition has been filed to suspend the sentence imposed on the petitioner by the judgment dated 28.02.2023 in Crl.A.No.646 of 2014.

2. The Criminal Appeal is pending from 2014. Despite several opportunities, none appeared on behalf of the respondent to argue the matter. Hence, this Court directed the Registry to appoint a competent legal aid counsel for arguing the matter on behalf of the respondent. Registry has also appointed Mr. Muthuvisakan, as legal aid counsel for the respondent. This Court after hearing the arguments of learned Additional Public Prosecutor and legal aid counsel appearing for the respondent and also after a careful perusal of the materials available on record, delivered the judgment. 1/3

3. Mr.John Sathyan, learned Senior Advocate appearing on behalf of Mr.Swami Subramanian, learned counsel for the respondent submitted that earlier counsel for the respondent on record died. He filed the present Criminal Miscellaneous Petition seeking suspension of sentence, till filing of Special Leave Petition.

4. In view of the above and also considering the nature of the offence, this Court is not inclined to suspend the sentence. Hence, this Criminal Miscellaneous Petition is dismissed. 02.03.2023 mfa 2/3
