(Order of the Court was made by R.SUBRAMANIAN, J.) These petitions have been filed seeking to condone the delay of 679 days in filing the petition to set aside the abatement caused due to the death of the sole appellant, to set aside the abatement caused due to the death of the sole appellant and to bring on record the legal representatives of the deceased sole appellant and ranked them as appellants 2 to 5.

2. Accepting the reasons assigned in the affidavits filed in support of these petitions, these petitions are allowed. The delay of 679 days in seeking to set aside the abatement is condoned, the abatement caused by the death of the sole appellant is set aside and the petitioners 1 to 4 are brought on record as legal representatives of the deceased sole appellant and are ranked as appellants 2 to 5 in the Appeal.

3. Registry is directed to carry out the necessary amendment in the Appeal.
