This application has been filed under Section 29A of the Arbitration and Conciliation Act seeking for extension of time for the Arbitrator to pronounce the arbitral award by another period of six months.
2. In the affidavit filed in support of this application, the applicant had stated that in the arbitration, the respondents were set exparte by the Arbitrator. The proceedings of the Arbitrator has also been placed on record which revealed that the respondent were set exparte by the Arbitrator.
3. Since sufficient cause has been shown by the applicant for seeking extension of time and since the respondents have already been set exparte by the Arbitrator, this Court is inclined to allow this application as prayed for. Since the respondents have been set exparte in the arbitration, notice to the respondents is dispensed with. Accordingly, this Application is allowed as prayed for by granting time for the Arbitrator by another period of six months for pronouncing the arbitral award.
