The learned Counsel for the appellant is present submitted that due to considering his financial position and the continuous pain and suffering in the body, he could not concentrate in his routine works. Coupled with the financial position, he was unable to concentrate in filing the appeal which caused a considerable delay. Hence, he cannot preferred the appeal in time. He has further submitted that earlier its Court by its order dated 10.06.2019 has allowed the petition for enhancement of compensation.
2.Hence, considering the submission made by the learned Counsel for the appellant, the delay is condoned on payment of cost of Rs.1000/- to be paid to the 'High Court Legal Services Authority, Chennai', within a week and Batta to be paid within a week and effect the service to be made within two weeks, failing which, the Civil Miscellaneous Appeal will be rejected. 2.Registry is directed to print the name of M/s.V.Surekha for the respondent and post the matter after two weeks. 19.08.2019 jas http://www.judis.nic.in
