This petition is filed to condone the delay of 438 days in filing the above said appeal.

2.The reason stated in the affidavit is that the petitioner could not concentrate in his routine work due to financial position and the continuous pain and suffering in the body and hence, he could not prefer the appeal in proper time.

3.Considering the reason stated by the learned counsel for the petitioner, the delay of 438 days is condoned on payment of cost of Rs.1,000/- (Rupees One Thousand only) to 'Kaakkum Karangal' (Old age Home) at No.212/54, Amman Kovil Street (near chicken market), Parrys, Chennai 600 001. [Cell No.9840068800/ 9840068889], within a period of four weeks from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court. Further, the petitioner is also permitted to claim any interest in respect of the delay period in filing the appeal.
