W.M.P.Nos.7366 & 7391 of 2019 in W.P.Nos.27366 & 27384 of 2018 V.PARTHIBAN,J., The writ petitions have been filed against the award of the Labour Court ordering reinstatement of the workmen with backwages vide award dated 30.11.2017.

2. When the matters are taken up for hearing, the learned counsel appearing for the workmen has come up with the miscellaneous petitions in W.M.P.Nos.7366 and 7391 of 2019, seeking last drawn wages in view of the reinstatement, under Section 17(b) of the Industrial Disputes Act.

3. Since the workmen have not been reinstated in service in terms of the award passed by the Labour Court, the workmen are entitled to last drawn wages as per Section 17(b) of the Industrial Disputes Act. Therefore, the present miscellaneous petitions are ordered.

4. The petitioner Management is directed to pay the arrears of last drawn wages payable to the workmen from the date of the award till date and continue to pay the monthly wages to them. The direction shall be complied with by the petitioner Management, within a period of four weeks from the date of receipt of a copy of this order.
