ORDER

This Writ Petition is filed seeking to a Writ of Mandamus directing the 3rd respondent to measure the land in S.No.601/2 situated at Santhirapum Village, Parandapallai Post, Tirupattur District as per the order passed by the 2nd respondent in Moo.Mu.D2/6741/2022 dated 06.08.2022 and issue fresh Patta towards the land comprised in S.No.601/2 within a stipulated period as fixed by this Court.

The case of the petitioner is that the petitioner gave a representation to the 1st respondent on 20.06.2022 to change modification UDR Patta No.182 as per the sale Deed ini document No.3376 of 1984 and baed on the representation, the 2nd respondent conducted enquiry on 26.07.022 with the petitioner and 5th respondent and passed an order in Moo.Mu.D2/6741/2022 dated 06.08.2022. Thereafter, the 2nd respondent, forwarded the said order to the 3rd respondent for necessary action. However, there was no action on the part of the 3rd respondent. Hence, the present Writ Petition is filed. 2/5

3. Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents.

Having regard to the submissions made by the learned counsel on either side and since the Writ Petition is filed seeking a simple Writ of Mandamus, this Court without expressing any opinion with regard to the merits of the case, directs the 4th respondent to issue notice to the petitioner, adjacent land owners of the four boundaries of the subject property, interested parties/rival claimants/aggrieved parties/objectors if any, as the case may be and conduct enquiry in the manner known to law and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 13.03.2024 ksa-2 Index : Yes / No 3/5
