O R D E R

The prayer made in the writ petition is to issue a writ of Mandamus Mandamus to direct the 3rd respondent to include the petitioner's name in the promotion panel for 2017 for BT Assistant [Science] drawn by him for the K.V.Kuppam Union in Vellore District and hold the counselling to the petitioner also for promotion to the said post, based on the petitioner's representation dated 08.04.2017.

2. Heard Ms.S.Pradeepa, learned counsel appearing for the petitioner; Mr.Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the respondents and perused the materials placed on record.

3. The petitioner is a triple major decree holder. According to the petitioner, the 3rd respondent has not considered her name for promotion, on the statement that there is no rule to permit those who have passed triple major decree. On the other hand, there is no prohibition in the rules to deny promotion to them.

4. On perusal of the typed set of papers, it is seen that the petitioner had already filed W.P.No.32411 of 2016 before this Court, challenging the proceedings of the District Elementary Educational Officer, Vellore District, dated 06.08.2016 and to direct the respondents 1 to 4 therein, to promote the

petitioner to the post of B.T.Assistant [Science] in operation of the panel for the year 2016 and the same is pending.

5. Considering the facts and circumstances of the case, this Court directs the 3rd respondent to permit the petitioner to participate in the counselling scheduled to be held on 22.05.2017, subject to the result of the writ petition in W.P.No.32411 of 2016.

6. The writ petition is disposed of accordingly. There is no order as to costs.
