Though, the suit property is located in the patta land of the petitioner herein, it is the common pathway which is used by the general public of three village people.

Therefore, the petitioner has failed to make out a prima-facie case for interim relief.

2. Therefore, this Court is not inclined to grant interim injunction to the petitioners. Accordingly, this Civil Miscellaneous Petition stands dismissed.
