Petitions filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to order dated 29.11.2011 made in I.A.Nos.200, 202 and 198 of 2010 in I.D.Nos.106, 107 and 68 of 2007 respectively, on the file of first respondent and set aside the same and allow the said application, consequently direct the first respondent to take up the set aside application in I.A.Nos.201, 203 and 199 of 2010 in I.D.Nos.106, 107 and 68 of 2007 respectively, on his file and dispose of the same on 1/4

merits in accordance with law.

For Respondents : R1 - Court Mr.D.Prasanth for R2 for M/s.S.Senthilnathan in W.P.Nos.35112 & 35113 of 2012 R1 - Court Mr.S.T.Varadharajalu for R2 in W.P.No.35114 of 2012 C O M M O N O R D E R The writ petitions have been filed seeking issuance of Writ of Certiorarified Mandamus to call for the records relating to order dated 29.11.2011 made in I.A.Nos.200, 202 and 198 of 2010 in I.D.Nos.106, 107 and 68 of 2007 respectively, on the file of first respondent and set aside the same and allow the said application, consequently direct the first respondent to take up the set aside application in I.A.Nos.201, 203 and 199 of 2010 in I.D.Nos.106, 107 and 68 of 2007 respectively, on his file and dispose of the same on merits in accordance with law. 2.The learned counsel appearing for the petitioner as well as the learned counsel appearing for the respective second respondent submitted that during the pendancy of the writ petitions, the matter was amicably settled inbetween the parties and the petitioner 2/4

Management agreed to pay a sum of Rs.2 Lakhs each in full quit to the respective second respondent and they further submitted that the petitioner has already deposited a sum of Rs.99,394/- before the first respondent and the said amount may also be disbursed in favour of the respective second respondent.

3.In view of the above, the petitioner is directed to deposit a sum of Rs.6,00,000/- (Rupees Six Lakhs Only) [Rs.2 Lakh each] to the credit of I.D.Nos.106, 107 and 68 of 2007 respectively, before the first respondent, within a period of four weeks from the date of receipt of a copy of this order. On such deposit being made, the first respondent is directed to disburse the amount of Rs.6 Lakhs and Rs.99,394/- along with accrued interest, equally, to the respective second respondent, within a period of two weeks thereafter. 4.The writ petitions are disposed of with the above terms.
