ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 329(4), 296(b), 115(2),

118(1), 351(3) of BNS, 2023 in Crime No.18 of 2026, seeks anticipatory bail.

2. The allegation against the petitioner is that when a wrong call was made to the petitioner herein, the petitioner quarrelled with the defacto complainant and threatened him with dire consequences, and further he came to the house of the de facto complainant, trespassed, and attacked him with a knife, caused severe cut injuries and also, after the victim was admitted to hospital, a complaint was lodged, and the case has been registered.

3. The learned counsel for the petitioner would submit that in this case, the victim was discharged from the hospital, and though there is 1 previous case reported, it is only an offence under Section 506(i) of IPC, and he is ready to cooperate with the investigation. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that totally two persons were injured in this case, and one person is still taking treatment, and the investigation in this case is pending, and the petitioner is also having one previous case. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the allegation and the manner in which the occurrence had taken place, and the fact that one of the injured is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner.
