THAMILSELVI CRIMINAL MISCELLANEOUS PETITION No.4201 of 2022 IN CRL OP.4432 of 2022 1 PERIYASAMY [ PETITIONERS / ACCUSED 2 PATTU A2,A3, A6 TO A11 ] 3 RASU @ RAJENDIRAN 4 KALIYAMOORTHY 5 DHARMAR 6 SEPPERUMAL 7 RANI 8 MARIMUTHU Vs THE INSPECTOR OF POLICE [ RESPONDENT / COMPLAINANT ] AWPS POLICE STATION, PERAMBALUR DISTRICT CRIME NO.34 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed in para No.6(b) the petitioners shall deposit a sum of Rs.1,00,000 (Rupees one lakh only) to the credit of Crime No.34 of 2021 and the victime girl is permitted to withdraw the said amount in Crl.O.P.4432 of 2022 by an order dated 03.03.2022 and pass such further or other order as this Hon'ble Court may deem fit and proper and thus render justice.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of G.ILAMURUGU, Advocate for the petitioners and of MR.L.BASKARAN, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed by the petitioners to modify one of the conditions imposed on them by this Court in Crl.O.P.No.4432 of 2022 dated 03.03.2022.
2. The learned counsel for the petitioners submits that while granting anticipatory bail to these petitioners, this Court directed the petitioners to deposit a sum of Rs.1,00,000/- to the credit of Crime No.34 of 2021. He further submits that this Court has already granted bail to the first accused/husband with the same condition and he also deposited the amount before the learned Sessions Judge, Mahila Court, Perambalur, to that effect, the petitioners have produced the receipt dated 16.02.2022 before this Court. Hence, he prays for modification.
3.Considering the facts that A1 has already deposited the said amount to the credit of Cr.No.34 of 2021 while he was granted anticipatory bail in Crl.OP.No.1972 of 2022 dated 03.02.2022 before the learned Sessions Judge, Mahila Court, Perambalur on 16.02.2022, the petitioners who are in-laws and relatives herein need not to deposit any amount to the Crime number.
4. Except the above modification, the other conditions imposed by the Court in Crl.OP.No.4432 of 2022 vide order dated 03.03.2022, shall remain unaltered.
