Respondents PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to implement the award dated 15.11.2010 passed in Industrial Dispute No.24 of 2008 on the file of the Central Government Industrial Tribunal-cum-Labour Court, Chennai/second respondent herein by passing appropriate orders of payment of full back wages, continuity of service and all attendant benefits within a time limit to be fixed by this Honourable Court.

O R D E R

The relief as such sought for in the present writ petition is for a direction to direct the first respondent to implement the award dated 15.11.2010 passed in Industrial Dispute No.24 of 2008 on the file of the Central Government Industrial Tribunalhttps://hcservices.ecourts.gov.in/hcservices/

cum-Labour Court, Chennai/second respondent herein by passing appropriate orders of payment of full back wages, continuity of service and all attendant benefits.

2.This Court is the considered opinion that the Industrial Disputes Act under the amended Provisions of the Industrial Disputes Act, the petitioner has to file an Execution petition before the Competent Court of Law for the purpose of implementing the award passed by the Labour Court. In the regard, the petitioner is at liberty to approach the Competent Court of Law for the purpose of implementation of the award passed by the Labour Court.
